The Agency acts only as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Other Suppliers”). The Agency is not responsible for acts or omissions of the Other Suppliers or their failure to provide services or adhere to their own schedules.
The Agency assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Other Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Other Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under The Agency's control. The Passenger hereby releases The Agency from all claims arising out of anything covered by this paragraph. The Agency has no special knowledge regarding the financial condition of the Other Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which The Passenger may travel. For information concerning possible dangers at destinations, The Agency recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, The Agency recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. The Passenger assumes full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of The Passenger's destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). The Passenger hereby releases The Agency from all claims arising out of anything covered by this paragraph. The Passenger agrees that the courts in Miami, Florida, will be the exclusive jurisdiction for all claims brought by The Passenger or The Agency and The Passenger hereby submits to the personal jurisdiction of those courts. The Passenger agrees to present any claims against The Agency within 30 days after the services end and to file within one year of the incident, and The Passenger acknowledges that this expressly limits the applicable statute of limitations to one year. The Passenger will be liable for all The Agency's attorney costs if The Passenger is unsuccessful in any legal action against The Agency. The Passenger agrees to grant The Agency (and third parties with whom The Agency may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use The Passenger's photographic, video, or digital likeness solely for our promotional and/or commercial purposes.
The Passenger must thoroughly review the itinerary and tickets in their entirety once rendered. The Passenger must verify all passenger accommodations, ascertain that all names are correct, and match the documentation that will be using for identification. Many travel suppliers require pre-registration forms completed online or via fax. These forms must be completed prior to the vacation; it is The Passenger's responsibility to make certain this has been done prior to The Passenger's vacation. Suppliers may charge substantial Penalties plus applicable fare increases for changes made after the tickets or documents are issued.
For your protection, we strongly recommend The Passenger to purchase travel insurance protecting persons and property from the risks of accidents, injuries, illness, theft, loss or delay of documents or personal items, cancellations, trip interruptions, delays in reaching destinations and medical expenses. We give to The Passenger the option to purchase travel insurance using our services when accepting this Agreement and the solely use of our website. If interested, The Passenger must accept expressly checking the appropriate box (“I do wish to purchase travel insurance”) and refer to our section “TRAVEL INSURANCE” in our website or contact our travel professionals for assistance and fulfilling this will. This intention will not be considered fully fulfilled until The Passenger does effectively execute it purchasing travel insurance through our services. If The Passengers opts to check “I do not wish to purchase travel insurance” or if The Passenger does not check a box, The Agency will assume that The Passenger is not interested in travel insurance and The Passenger will not be able to make The Agency responsible for any expenses or losses or lack of compensations The Passenger might have as a consequence of any of the risks mentioned in this paragraph that may arise to The Passenger during the duration of the trip or any of the services arranged by The Agency. The Agency is not authorized to vary or amend the insurance policy's terms. The Agency also strongly recommends that, in case The Passenger wishes to purchase travel insurance, The Passenger uses a credit card for the purchase, so that The Passenger can exercise His rights under the Fair Credit Billing Act if The Passenger does not receive the services purchased.
The Passenger (as described in our Terms and Conditions) has the right to a reimbursement of all amounts paid minus the cost of all reservations and administrative and compensation fees (“Penalties”). All Penalties are due from The Change or Cancellation Date. If Penalties are higher than all amounts paid, the Passenger must pay immediately the remaining difference to us or to Other Suppliers directly when it is so indicated. Other Suppliers are tour operators, airlines, cruise lines, travel insurance companies, hotels or other travel suppliers that may participate in the reservation.

The Passenger has always the right to change or cancel a reservation. Changes and cancellations attributed to The Passenger are subject to Penalties. The Passenger must notify us immediately if changes, corrections or cancellations are required. All requests to change or cancel a reservation, before or during the trip, must be communicated to us by certified mail, fax, or email along with authorization to charge any Penalties involved. The Change or Cancellation Date is the day we receive a written document in which The Passenger makes this request. The Passenger has to ensure these notifications arrive to us in a timely manner. If The Passenger changes a reservation we may charge up to a $50 administrative fee per person, including name changes. If The Passenger cancels a reservation we may charge up to a $75 administrative fee per person. The Passenger assumes full responsibility for those Penalties.
Our Penalties for changing or cancelling reservations are additional to any Penalties that Other Suppliers may apply. Please note that some of those Other Suppliers may sometimes charge Penalties of 100% of the total cost of the reservation (Non-refundable Services). The Passenger assumes full responsibility for all those Penalties too, so we always recommend to contact the travel supplier directly or us for details. Unawareness of these Penalties does not exclude from this responsibility.
Failure to show up at the departure date and time of a Non-refundable Service will result in a compensation fee equivalent to the total value of that service.
Changes or Cancellations of reservations by The Passenger due to a notification of The Agency of an increase in rates of more than a 10%, 7 days or less prior to the Initial Date of the trip, due to a variation on the currency of exchange, will not be subject to any Penalty of any kind by The Agency and all payments made by The Passenger will be refunded in full.
If The Passenger cancels a reservation, additionally to the administrative fees mentioned in The General Refund Policy, The Passenger agrees to pay the following compensatory fees: if The Change or Cancellation Date is more than 60 day prior to the trip Initial Date, $75; if The Change or Cancellation Date is between 60 and 30 days prior to the Initial Date, 10% of the Total Cost of the Trip if The Change or Cancellation Date is between 29 and 15 days prior to the Initial Date, 15% of the Total Cost of the Trip; if The Change or Cancellation Date is between 14 and 3 days prior to the Initial Date, 25% of the Total Cost of the Trip; and if The Change or Cancellation Date is 2 days or less prior to the Initial Date, or if you are a no-show, you shall incur a cancellation fee equal to 100% of the Total Cost of the Trip. Initial Date and Total Cost of the Trip for these purposes are publically defined in our Terms and Conditions Policy.
We will make commercially reasonable efforts to keep all our itineraries as they have been planned; however, the final itinerary may vary due to third parties’ schedules, availability, and other factors beyond our control that may can even lead to a different dates. In those cases we may in our sole discretion substitute services or goods of similar quality for any service or good stated in the itinerary. If for those reasons a tour would be subject to changes that would affect their initially scheduled dates, The Passenger may cancel the reservation at The Passenger’s sole discretion and will be entitled to a full refund of the cost of the trip, and we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances.
Every tour requires a minimum number of participants, and we may cancel the tour and refund all your payments if we deem the number of passengers signed up for a given tour to be insufficient to operate the tour. We may cancel any tour at any time before departure for any reason. If a tour is cancelled, our liability is limited to a full refund of your payments, and we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances. If for reasons beyond our control, a tour in progress must be interrupted or cancelled, we will in good faith consider refunding a portion of the tour price depending on our actual costs incurred compared to the tour as originally contemplated.
To ensure desired group harmony we may exclude The Passenger from participating in all or any part of the tour if, in our sole discretion, if we consider that The Passenger’s condition or behavior renders The Passenger unfit for the tour or unfit for continuation once the tour has begun (unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment); in such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the tour.
